Guy Sebastian’s showdown with former manager Tito Day nears completion

The long trial of former Guy Sebastian manager Titas Day is nearing completion, and the prosecution is defending its case despite numerous mistakes.

Mr Day has pleaded not guilty to 50 counts of fraudulent embezzlement of nearly $ 900,000 allegedly belonging to a former Australian idol star and reality TV judge.

Last week, jurors were instructed to hand down innocent sentences on three of the 50 charges because there was no evidence to suggest that Mr. Day misappropriated funds – about $ 14,600 – listed in those counts.

Last week, jurors were instructed to hand down innocent sentences on three of the 50 charges because there was no evidence to suggest that Mr. Day misappropriated funds – about $ 14,600 – listed in those counts.

Beginning his closing speech before a jury on Tuesday, Crown Attorney David Morters SC defended his case.

“The fact that there was a combination of payments that were not identified by Mr. Sebastian or the (police) officer or the prosecutor’s office does not demonstrate incompetence,” he told the jury.

“The charges were legally dropped, but this does not reflect the validity of the other 47 charges.

“There are a lot of threads that can be linked to all the evidence you’ve got.”

Mr Morters said Mr Sebastian was “an honest and open witness who did his best to convey accurate information”.

The court was told that while Mr. Sebastian and Mr. Day had not signed a management contract, there was an agreement requiring Mr. Day to pay Sebastian 80 percent of the gross income he collected on behalf of the singer within 14 days of his income. . are accepted.

Mr Morters said the deal reflected an agreement Mr Sebastian had with his former management company 22 Management, and it did not include a clause that allowed Mr Day to qualify for a share in future profits – known as trailing commissions – generated by Mr -nom Sebastian after the expiration of any agreement. .

The court was told that while Mr Sebastian was terminating his contract on 22, Mr Day sent an e-mail to Mr Sebastian’s accountant stating that “there are no other commitments to 22 other than the publishing commissions”.

During the trial, it was reported that Mr. Day claims that Mr. Sebastian owes him money – a claim denied by Mr. Sebastian.
